How can the companies get away with this? Simple. The language of the insurance contract permits them to do it, and inadequate enforcement by most state insurance departments doesn’t stop the companies from wielding the ax in an unfair and capricious manner.

Cancellation of an Existing Policy

There are two issues of concern to this discussion: cancellation of an existing Galveston Health Care policy, and refusal to renew a policy once its term has expired. First, let’s look at a typical Galveston Health Care policy regarding the issue of cancellation.

You can cancel at any time. If you become unhappy with your company or wish to cancel, you can do so by giving the company a written notice of when the cancellation is to take effect or by returning the policy. If this is done, the company must return to you any unearned premiums.

The company can cancel for several reasons. It is rare for a company to cancel a Galveston Health Care policy while it is in effect. However, it may do so under certain conditions. These include:

Nonpayment of premiums. If you don’t pay in a timely fashion, the company can cancel you on 10 days’ (or so) written notice.

During the first 60 days. During the first 60 days the policy is in effect, it is subject to cancellation upon reasonable notice (often 10 days) for any reason. Since agents often bind their company to a policy, the laws of the states permit companies to cancel. If this is done, it is usually because the insured has somehow misrepresented the facts and circumstances surrounding the issuance of the Galveston Health Care policy.

If your driver’s license or that of a covered householder is cancelled. The insurance industry keeps a constant watch on the driving records of its insured’s. If you or a covered member of your household has their license suspended or revoked, your company may follow suit with your insurance coverage.

If you or a covered member of your household is convicted of drunk driving. Clearly it is not in the interests of a Galveston Health Care company to insure the automobiles of those foolish enough to endanger themselves and others by driving while intoxicated. And it doesn’t take much to be legally drunk. Often a couple of drinks or several beers over an hour or so will make you a prime candidate for an accident, jail, or both, if you then are irresponsible enough to try to drive a car.
